Farm land: only impose the conditions provided for by law

A person filed a complaint against the Commission de protection du territoire agricole du Québec, which had sent them a formal notice.

The person had inherited family farm land by means of a testamentary trust.

The Commission considered that the land belonged to the trust, and not to the person. Because the person no longer lived in Québec, they either had to sell the land or request authorization to keep it. However, the person's application could be denied.

According to the law, someone who inherits Québec farm land may keep it. The person's place of residence does not change anything, nor does the fact that the process involves a trust.

After we intervened, the Commission cancelled the formal notice.
