Consent to care: essential, even when patients are hospitalized against their will

A citizen lodged a complaint against a hospital where he was treated without consenting.

The man had been hospitalized and placed in restraints because he posed a danger to himself or to others.

The physician had asked for a sample to be taken, but only once the man had calmed down. The staff did so immediately, even though the man did not want treatment at the time.

At the Protecteur du citoyen’s request, the staff and managers concerned were reminded of an important rule. Before providing non-emergency care to patients, their free and informed consent must be obtained.

Even if someone is hospitalized under P-38, their consent to care is essential. There are exceptions, however, for emergency or hygiene care, or for court-ordered examinations.
