Problems with the application of the Act respecting the protection of persons whose mental state presents a danger to themselves or to others (R.S.Q., c.P-38.001)

The Québec Ombudsperson has made recommendations to the Minister of Health and Social Services, aimed at correcting a number of problems with the implementation of an Act that is applicable in certain exceptional circumstances only. During the Protecteur du citoyen's investigations, some significant disparities were observed in the way the Act is applied in different institutions and regions, and by different people involved in the process.
