Draft Regulation to amend the Regulation respecting mandatory lease forms and the particulars of the notice to a new lessee

The Québec Ombudsman subscribes to the efforts of the Régie du logement to improve the mandatory lease forms. However, it recommends that certain special rules applicable to leases of private seniors' residences, introduced in 2011 to tighten the certification process for seniors' residences, be mentioned in the new lease forms, particularly regarding:

  • access to the dwelling by a person designated by the Health and Social Services Agency when it wishes to revoke or refuses to issue or renew a holder's certificate of compliance;
  • protection of the lessees of private seniors' residences when a holder's certificate of compliance is revoked, refused or not renewed. In these cases, seniors may terminate their lease and obtain assistance for their relocation, in particular.
