Draft Regulation respecting the selection procedure and the training of investigators of the Bureau des enquêtes indépendantes

The Québec Ombudsman endorses the draft Regulation respecting the selection and the training of investigators of the Bureau des enquêtes indépendantes (BEI), and feels that it is crucial that the Bureau be established as soon as possible.

While pointing out that the draft regulation is one of the first concrete phases in getting the Bureau off the ground, the Québec Ombudsman made certain comments aimed at strengthening the selection process contemplated, especially regarding the following content:

  • Declaration of penal offences likely to call integrity or impartiality into question
  • Grounds for the withdrawal of selection committee members
  • Effect of the absence or inability to act of the director of the Bureau des enquêtes indépendantes

As early as February 2010, the Québec Ombudsman suggested the creation of an independent bureau of investigation in a special report tabled in the National Assembly.
