Draft Regulation to establish a pilot project on mandatory mediation for the recovery of small claims arising out of consumer contracts

The Québec Ombudsman welcomes the draft regulation, which provides for the establishment of mandatory mediation for the recovery of small claims arising out of consumer contracts in Gatineau and Terrebonne for a three-year period.

According to the Québec Ombudsman, the pilot project should foster settlement of disputes in matters of consumer contracts effectively and within a reasonable time frame, while keeping litigation out of the court.

The Québec Ombudsman considers that mediation can contribute to solving problems of accessibility to justice due to lengthy waits, complex procedure and the legal fees paid by citizens, issues which the Québec Ombudsman has seen time and again and which it continues to find worrisome. The Québec Ombudsman points out that recourse to it can in itself be a non-judicial solution to grievances between citizens and the government.
