Draft Regulation to amend the Regulation respecting legal aid
In a letter to Justice Minister Sonia LeBel, Ombudsperson Marie Rinfret commented on the draft Regulation to amend the Regulation respecting legal aid.
The aim of the draft regulation is to change the rules governing how income is determined, so that amounts of up to $4,200 per year per child received as child support are not included for income determination purposes. The Québec Ombudsman applauds this gain, which it feels will make legal aid more accessible for low-income families that receive child support.
However, Ms. Rinfret considers that limiting the deduction to $4,200 per year per child is insufficient and that the full amount of child support must be deducted from income in order to determine eligibility for legal aid. Moreover, she recommended that the Minister of Justice provide for automatic indexation of the deducted amount on January 1 of every year.
