Bill 72 – Act to amend various legislative provisions concerning mainly bodies in the field of public safety
In a letter to the Chair of the Committee on Institutions, André Bachand, Ombudsperson Marie Rinfret commented on Bill 72. Her intervention dealt only with the provisions pertaining to the Bureau des enquêtes indépendantes (BEI).
In 2019, the BEI produced a report on its first three years of operation. The then director, Attorney Madeleine Giauque, made 14 recommendations. Bill 72 addresses some of them. However, the Bill currently does not provide for implementing two recommendations which the Ombudsperson considers particularly important. As Ms. Rinfret see it, it would be very useful to:
- define the notion of "police intervention;"
- provide for a maximum of 50% of former police officers among BEI investigators.
The Ombudsman made three recommendations in that vein to the Committee on Institutions.
